I had the privilege this past week of being hosted by Dean Stacy Leeds from the Arkansas School of Law at the school's Oil and Gas Symposium.

The Law School held the Symposium where Arkansas' oil and gas roots formed -- in beautiful small town El Dorado, Arkansas. The goal -- to celebrate the 75th anniversary of the Arkansas Conservation Act -- was made possible through some amazing efforts by Arkansas alumni and all around fabulous people Edwin and Diane Alderson. We tend to host these types of events in larger geographic areas, but this event reminded me of how important communities like El Dorado are to our national history, and that slowing down now and then to enjoy the finer points is a beautiful thing.

Thanks to Dean Leeds, her amazing entourage, the Aldersons and PPGMR, a Little Rock law firm, for having me and for being such great hosts.

My talk focused on ethics in eDiscovery and Technology and we went through the specific tasks that lawyers need to know to perform eDiscovery competently according to the recent ethics decision from the California bar. We also reviewed the Pennsylvania Bar's opinion on ethics issues in social media. Both will be covered on our blog next week, and you'll want to pay attention. These two opinions will likely set the bar for what other states will begin to adopt in the next couple of years, and you want to make sure you know what lies ahead.

Since we missed Legal Briefs last week due to travel, we've put together some terrific content below. I encourage you to watch Judge Facciola's talk from the UF Law School. You will learn from him, I guarantee it.

New proposed eDiscovery rule in NY would make the complex and time-consuming process of discovery in commercial cases more certain by requiring specifics about why parties are denying turning over documents. Public comments are being accepted now. Read more about it.

Judge Alan Pendleton, a state court judge in Minnesota, has penned a blog titled Pendleton Judicial Trial Updates. The blog is dedicated “to the Training & Education of the Minnesota Trial Bench and Attorneys” and includes sites to multiple resources that are useful for practitioners and judges alike.

Magistrate Judge John Facciola, a great friend of our firm and a brilliant jurist, spoke at the University of Florida speaker symposium recently. You can view the presentation in full here, and believe me, you want to watch it. Kudos to Bill Hamilton at UF for organizing a great event.

Check out this new legal research site — Ravel Law — that allows you to search by keyword. The US Supreme Court and US Circuit Courts are free, and other courts require a subscription at $100/month or $1100/year.

If you are blogging for your practice, be sure your blog posts don’t come back to bite you. Taking a different position in court? Your blog could be used to impeach your argument. New twists in the online world where a Google search can help you find great information.

Yikes. Facebook is suing the lawyers who represented Paul Ceglia. Ceglia falsified documents that claimed he had an 84% ownership in Facebook and was arrested for it. DLA Piper is on record saying "they had “100 percent confidence that [Mr. Ceglia's] agreement is authentic.” DLA Piper calls it an intimidation tactic to preclude lawyers from filing against Facebook.
