President's Message- November 2019

November begins a new management year for your association following the 2019 Annual Meeting. At the meeting, three directors were elected for two-year terms. The three incumbents Doug Craig, Wayne Bass, and Lee Kemmet were re-elected. In a special edition of the Birkdale Bulletin after the Annual Meeting, we reported on accomplishments of the previous year. If you haven’t read that, please get it from the website. We are very pleased with our accomplishments this year.

The first requirement of a newly elected Board is the election of officers. The Board has remained intact and the role of the officers will likely continue. This will be confirmed at the next Board meeting, November 12th at the clubhouse. At this meeting, we will also approve the 2020 budget.

At the Annual Meeting, there were questions about filing complaints either with the Board or the county concerning covenants, road conditions, environmental/aesthetic concerns, and more. These are presented later.

Your 4th quarterly Birkdale assessment of $101 was due on October 1, 2019. Is your account current? Birkdale’s Community Manager, ACS West, Inc., has issued 81 first notices for delinquent accounts. In addition, 14 owners have been notified of shortages in their accounts. Additional fees and late charges apply if your payment is not paid when due. Currently, Birkdale’s delinquency exceeds $36,000!

Equity Experts, Birkdale Community Association’s collection agency since November 2016, currently is handling 24 delinquent accounts. Following the Birkdale Community Association’s Collections Policy, the BCA Board has authorized Equity Experts to file liens and other legal actions, including foreclosures.

Once an account has been referred to our collection agency, Equity Experts, residents must deal with the collection agency, not individual Board Members nor ACS West, our Community Manager.

Delinquent homeowners pay all collection fees. These charges can be substantial since the collection agency bills for each contact, service, and procedure. There is NO CHARGE, however, to our association.


At the November 12, 2019 meeting of the Board of Directors of the Birkdale Community Association, action on the 2020 Budget is anticipated. Yearly dues will remain at $404, or $101 per quarter.


Is your address correct for receiving your bill from the Birkdale Community Association? Some residents have stated that they have not received notices regarding their delinquent accounts. It is the responsibility of each owner to notify ACS West, Inc. if there is a change in his billing address or any name change on the account.

Every resident can be the eyes and ears of the association and the county for many purposes and for the benefit of all. The Association, through the Board of Directors and the Covenants Committee, has the authority to enforce the standards to which we all agreed when purchasing property in Birkdale. These standards and rules may be in the Declarations, Bylaws, Articles of Incorporation, or Architectural Standards and Guidelines. Although there is a recommended form for the submission of a complaint or comment, it can also be done by sending an email to Replies are generally not issued.


Birkdale is a planned community that has a certain authority and responsibility. However, an even greater authority rests with Chesterfield County or Virginia Department of Transportation.

The Chesterfield Department of Community Enhancement’s mission is “Improve the value, quality, and attractiveness of Chesterfield County”. Details of these standards and a complaint form are on their webpage. Access these in this order:, My Community, Community Enhancement; File a Complaint. Complaint categories are Animals, Business, Code Enforcement, Housing, Litter, and Vehicles. Be aware that issues of personal concern may not be a violation of the county code.

The Virginia Department of Transportation is responsible for the roads in Birkdale including maintenance and snow removal. The VDOT website for reporting problems or filing comments is Regulations concerning Birkdale roads are part of the Chesterfield Code of Ordinances; some are parking regulations and others may be in zoning.

Finally, we have got some rain that has helped with our over stressed lawns and has brought beautiful fall colors to our trees.

There is also another concern with the requests that are being sent into ARC. When the homeowner is requesting to add something to their home (I.e. fences, patios, porches, decks, etc.) they will need to include a plot plan of their property that would show the placement of the proposed addition. A plot plan can be found in the information they receive when they settle for their house.

Mailbox Maintenance

Mailbox maintenance is the homeowner’s responsibility, and the specific requirements are in the ARC Guidelines.

When painting your mailbox, Lowe’s on Hull Street has the equivalent paint color as Benjamin Moore which is Lowe's - Valspar, Quart, 372, Birkdale Vanilla Cookie, Exterior Satin, Duramax, 105-1, 107-1, 214-2.5.

For your metal mailbox, Cottage Red Benjamin Moore is available at Virginia Paint and can also be mixed at Lowes.

New Solar Lighting are Being Installed

The board has approved the replacement of all gas lamps in Birkdale. The plan is to replace five gas lamps at a time with new energy efficient solar lamps. The first shipment of 10 is expected in November. The batteries are specified to last five years. The lights can operate up to five days with a good charge. Lamp will even charge on cloudy days. Lamps will remain on from dusk to dawn, however it has to get completely dark before they turn on. All lights are expected to be replaced by the end of the year.

In the meantime if you smell gas or think you smell gas around any of our lights, please call 911 then call the gas company at 1-800-543-8911.

If residents observe a problem with a gas light such as no light at night, please call Nick Martello at 804-739-7487.

Covenants Committee

The Covenants Committee is pleased to welcome new members. These members are volunteers who are appointed by the Board to fulfill this critical function. The Covenants Committee is an extension of the Board of Directors. It is empowered to enforce the standards established in the Declarations including the Architectural Standards. The success of this committee and the ARC Committee directly affect the overall appearance and high quality of Birkdale.

The Covenants Committee is pleased that all Violations noted during the annual inspection are being addressed. A few require significant work and commitments have been made. The Covenants Committee is sometimes questioned as to the areas most frequently cited for violations and the specific remedies required. Complaints which are investigated fall into two broad categories: committee identified and complaints filed. The committee identified violations mainly come from the inspection and are mailboxes, landscaping, and home maintenance such as power washing, rotting windowsills, and missing shutters. Complaints submitted for review most often are landscaping (grass cutting) and parking of trailers (utility, campers and recreation vehicles). The committee will initially send a “Friendly Reminder” not a violation letter to avoid the negative feelings. When the infraction is not addressed, a violation letter will be issued and placed in the homeowner’s permanent file. Temporary infractions may be overlooked initially but repeated infractions are not.

Decorating Birkdale’s street sign-posts with holiday wreaths is a great way to volunteer to for your community. Best of all, it takes just a little time to hang the wreaths and take them down in the new year! It helps if 2 people work together: one holding the ladder while the other person climbs up to hang the wreaths. Are you interested in helping with this project?

New Gazebo

A new Gazebo is now located in the Avalon area at Killarney Circle. It was installed last month and landscaping is now complete. This is a great addition to the area. Families are seen enjoying the gazebo while children ride bikes around the cul-de-sac. Thanks to Wayne Bass for all his hard work on this endeavor.
