The recent Department of Labor changes to overtime rules altered the kinds of employees that will soon be considered exempt from overtime pay and minimum wage laws. These modifications to the Fair Labor Standards Act impact most TYA companies. This webinar features an opportunity to learn about the new rules and how you or your company can respond to remain in compliance with the law. Utilizing the expertise of Seattle attorney Jared Van Kirk, scenarios unique to professional theaters as well as the TYA field will be addressed.

By Attending this Workshop, participants will be able to…
1. Identify what is changing with the Department of Labor update to the Fair Labor Standards act taking effect December 1, 2016 and whom it impacts.
2. Understand how the law affects TYA companies and their employees under a variety of scenarios (actors, company members, fluctuating hour needs, etc.)

Matthew Gutschick is Artistic Director of The Omaha Theater Company (The Rose) where he has directed Disney’s The Little Mermaid, Disney’s Mary Poppins, Greg Banks’s Robin Hood, Ramona Quimby, Christmas Story: The Musical. Under Matthew’s direction, The Rose has developed classes and productions for PreK audiences. He has also been instrumental in the commission, production and presentation of ground-breaking new works including Palette of Possibility, The Rose’s first show developed specifically for youth with autism. The Rose’s residency with Daniel Beaty has radically altered the company’s approach to outreach, with programs focused on gang violence, teen pregnancy, and youth incarceration. Matthew is a graduate of the School at Steppenwolf, member of Lincoln Center Directors Lab, and holds a BA from Wake Forest University. He earned an MFA in Theater Management from the Yale School of Drama.

Kimberly Motes became Managing Director for Children's Theatre Company(CTC) in February 2016 where she leads all business aspects for the theatre. CTC is the nation's premiere theatre for multigenerational audiences and an important cultural asset in Minnesota.

Motes most recently served as Senior Vice President for Institutional Advancement at the University of St. Thomas July 2014 to February 2016 where she led development, alumni and constituent relations, and university relations. Prior to St. Thomas, Motes was Vice President of Institutional Advancement for the College of Saint Benedict where she was responsible for all aspects of fundraising as well as alumnae relations, fine arts programming and the literary art institute.

Motes has an extensive background in arts management. She spent 20 years in the arts both in Minnesota and Washington, DC. As the Managing Director of Theater Latté Da she led all business and strategic aspects of the company which resulted in 40% growth in ticket sales and 82% growth in contributed revenue in two years. She was the Executive Director of the Minnesota Shubert Performing Arts and Education Center(now the Cowles Center), a new three building performing arts center dedicated to dance in downtown Minneapolis developed by Artspace Projects. Motes served as the Director of Development at Arena Stage in Washington, DC for five years. Prior to Arena, she directed adult arts education programming at the John F. Kennedy Center for the Performing Arts for six years. Prior to the Kennedy Center she worked at the Washington Ballet.

A native of Minnesota, Motes received her Bachelor’s Degree in Music from the College of Saint Benedict. She serves on the Board of the Minneapolis Downtown Council and of the Ivey Awards..

Jared Van Kirk large

Jared Van Kirk is an owner at Garvey Schubert Barer where he practices in the area of labor and employment. Mr. Van Kirk is a counselor to clients in a variety of industries on avoiding disputes and best practices for maintaining compliance with the complex suite of employment laws and regulations. Mr. Van Kirk’s expertise includes untangling the network of federal, state, and local laws that guarantee employees paid time off, family and medical leave and disability accommodation. Mr. Van Kirk also frequently addresses employers’ concerns about compensation practices, workplace policies, and employee drug use and drug testing in the workplace. Mr. Van Kirk represents employers in disputes arising out of collectively bargained labor agreements and against unfair labor practice charges. As a litigation attorney, Mr. Van Kirk’s practice includes defending companies against allegations of discrimination, harassment, and other workplace disputes.
